Switch 2 BONGO Giveaway Official Rules

Sponsor: First Service Credit Union (“Sponsor” or “First Service”), 16430 Park Ten Place, Houston, Texas 77084. 

First Service is conducting a “Switch 2 BONGO Giveaway,” (the “Giveaway”). First Service reserves the right to determine the eligibility of any entrant. Entrants determined to be ineligible will forfeit any prize.

Eligibility: The Switch 2 BONGO Giveaway is open to legal residents of the State of Texas who are at least eighteen (18) years of age as of the date of entry. Employees of Sponsor, its subsidiaries, their directors and volunteers, and members of their respective immediate families (spouses, parents, children and siblings), regardless of where they reside, and household members of such employees are not eligible to enter. By participating in the Giveaway, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. An entrant is not required to become a member of First Service, open an account, or purchase any product or service to enter or win. 

Entry Period: The Switch 2 BONGO Giveaway begins 9:00:01 a.m. Central Time (“CT”) September 7, 2026, and ends October 31, 2026, at 4:59:59 p.m. CT. 

A “BONGO Account” means either a First Service BONGO Savings account or a First Service BONGO Checking account. First Service BONGO Accounts are only available to children under the age of eighteen (18). For more information, visit: https://www.fscu.com/personal/checking-and-savings/bongo-youth-account/. 

How to Enter: NO PURCHASE OR ACCOUNT OPENING NECESSARY TO ENTER OR WIN. A PURCHASE OR ACCOUNT OPENING IS NOT REQUIRED TO PARTICIPATE. VOID WHERE PROHIBITED BY LAW.

For purposes of these Official Rules, the parent or legal guardian submitting an entry will be deemed the entrant. The minor identified in connection with the entry is not an entrant.

Eligible individuals may enter the Giveaway in one of the following two ways:

Account Entry: Open a BONGO Account at First Service for a minor for whom you are the parent or legal guardian during the Entry Period to receive one (1) Giveaway entry per eligible minor. If multiple BONGO Account types (e.g., savings and checking) are opened for the same minor, only one (1) Giveaway entry will be awarded for that minor. Accounts may be opened at any First Service branch or online at https://www.fscu.com/personal/checking-and-savings/bongo-youth-account/; or

Alternate Method of Entry (AMOE): To enter without opening a BONGO Account, an eligible parent or legal guardian may complete an AMOE entry on behalf of an eligible minor during the Entry Period using the official online entry form available at https://www.fscu.com/switch-2-bongo-giveaway. Entrants must provide all required information, including the parent or legal guardian's full name, phone number and email address, and the name and age of the minor being entered.

By submitting an AMOE entry, the entrant certifies that they are the parent or legal guardian of the minor identified in the entry and that all information submitted is true and accurate. False, fraudulent, incomplete, duplicate, or unverifiable entries may be disqualified.

Before awarding the prize, Sponsor may require the potential winner to provide additional documentation or information reasonably necessary to verify the entrant's identity, the identity and age of each minor identified in connection with the entrant's entries, and the entrant's relationship to each such minor. Such information or documentation may include, but is not limited to, valid government-issued photo identification and reasonable documentation establishing that the entrant is the parent or legal guardian of each minor identified. If the potential winner fails to provide the requested information or documentation within the time period specified by Sponsor, or if the information provided cannot be verified, the potential winner may be disqualified and an alternate winner may be selected.

All entries, regardless of method, will have an equal chance of winning. Limit one (1) entry per eligible minor during the Entry Period, regardless of method of entry. A parent or legal guardian may receive entries on behalf of more than one eligible minor. Duplicate entries submitted with respect to the same minor will be void. Entries received through the Alternate Method of Entry and entries received through opened BONGO Accounts will be combined into the same drawing pool and will receive equal weight.

Entries submitted through automated entry devices, bots, scripts, macros, or other methods designed to circumvent the entry process or entry limits are void and may result in disqualification, as determined by Sponsor in its reasonable discretion.

Drawing: The winner will be randomly selected from all eligible entries received during the Entry Period. Odds of winning depend on the total number of eligible entries. The winner does not need to be present to win. Winner will be notified by phone and/or email using the contact information provided. The drawing will be conducted by November 6, 2026, at 5:00 p.m. CT.

Prize: One (1) winner will receive a Nintendo Switch 2. The total approximate retail value (“ARV”) of the prize is six hundred dollars ($600.00). Only one (1) prize will be awarded. The prize is non-transferable, non-exchangeable, and may not be redeemed for cash or substituted. Sponsor makes no warranties regarding the prize and is not responsible for damage, loss, or any consequences related to the use of the prize. All federal, state, and local taxes are the sole responsibility of the winner. This Giveaway is not sponsored, endorsed by, or affiliated with Nintendo.

Prize Claim: Within five (5) calendar days after responding to Sponsor’s initial winner notification, the potential winner must sign and return an Affidavit of Eligibility, Liability Release, Publicity Release where permitted by law, and any other documents reasonably requested by Sponsor. The potential winner may also be required to provide information reasonably necessary to verify eligibility and deliver the prize. If the potential winner fails to timely return the required documents, fails to claim the prize, is determined to be ineligible, or otherwise fails to comply with these Official Rules, Sponsor may declare the prize forfeited and select an alternate potential winner. The prize will be awarded only after Sponsor verifies eligibility and compliance with these Official Rules.

Publicity: By accepting the prize, the winner agrees to permit First Service to use his/her name and likeness and/or the minor’s name or likeness for whom they are the parent or legal guardian for publicity and promotional purposes related to the Giveaway or First Service marketing without further compensation, notice or consent, in any and all forms of media, unless prohibited by law.

General Conditions: First Service reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by First Service in its sole discretion. In such event, First Service, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance. First Service reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and/or civil law, and should such an attempt be made, First Service reserves the right to seek damages from any such person as allowed by applicable law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to resolve, in its reasonable discretion, any ambiguity, error, omission, or circumstance not expressly addressed by these Official Rules, provided that any such determination is consistent with applicable law and the overall intent of the Giveaway. Sponsor's decisions regarding the administration and operation of the Giveaway are final and binding, except where prohibited by law.

No Inducement: Entry into the Giveaway is not conditioned on becoming a member, opening or maintaining an account, or purchasing any product or service from First Service. 

Compliance with the Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and First Service in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law provisions. All applicable federal, state, and local laws and regulations apply. 

Disputes: BY PARTICIPATING IN THE GIVEAWAY, YOU AGREE TO WAIVE ALL RIGHT TO TRIAL BY JURY OF ANY ACTION, SUIT, PROCEEDING, DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THE GIVEAWAY. In the event of a dispute arising out of this Giveaway, you and First Service will attempt in good faith to resolve the dispute by mediation before a mutually agreed upon mediator, or, alternatively, appointed by and through the American Arbitration Association (“AAA”), and to share equally in the cost of mediation. If the dispute is not resolved through mediation, then arbitration will apply. ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. The arbitration shall be conducted in Houston, Texas, by one neutral arbitrator chosen by AAA according to its Commercial Arbitration Rules. Except where prohibited by law, by participating, you agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway. 

Release of Claims: BY PARTICIPATING IN THE GIVEAWAY, ON BEHALF OF YOURSELF AND MEMBERS OF YOUR HOUSEHOLD, RELATIVES, HEIRS, ASSIGNS, EXECUTORS AND ADMINISTRATORS AND PERSONS WHO USE THE PRIZE AWARDED BY FIRST SERVICE, YOU RELEASE FIRST SERVICE, ITS EMPLOYEES, BOARD MEMBERS, AGENTS, OR REPRESENTATIVES (COLLECTIVELY “FIRST SERVICE PARTIES”) FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE GIVEAWAY, AND/OR USE OF THE PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY AND/OR DEATH, AND EACH PARTICIPANT AGREES TO INDEMNIFY AND HOLD FIRST SERVICE AND FIRST SERVICE PARTIES, JOINTLY AND SEVERALLY, HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KINDS ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE GIVEAWAY AND/OR USE OF THE PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY AND/OR DEATH. IN NO EVENT SHALL FIRST SERVICE AND/OR THE FIRST SERVICE PARTIES BE LIABLE TO ANY PARTICIPANT OR PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFIT, OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

Account holder must pass all subjects/classes to qualify for Semester Earnings. Semester Earnings will be deposited into the child’s Bongo Youth Savings Account. Eligible account holders may receive Semester Earnings once per semester, with a maximum of $10 per year for ages 6–10 and $20 per year for ages 11–17.
